Conditions13

Typed facts extracted from the source documents by Scindu's grant-data review. Each value keeps its own conditions. Unknown means unstated, not zero or unlimited.

Applicant restrictionIneligible expenditures
Prohibited uses include long-term institutional-care facility infrastructure, individual fossil-fuel boilers, excluded EFRR expenditures, production relocation, debt interest, prefinancing grant-funded parts, refinancing existing financing, financial assets for trading/investment, real-estate purchase, and double financing.

The regulation also excludes transactions WARR considers unreliable or uneconomical.

Applicant typePotential borrower category
Micro, small and medium enterprises

WARR regulation defines SMEs by Annex I to Commission Regulation (EU) No 651/2014; BGK page separately identifies micro, small and medium enterprises. SME classification must aggregate partner and linked enterprises where applicable; the WARR SME declaration requests cumulative applicant data and identifies separate partner/linked relationship annexes.

Application restrictionApplication file requirements and conditional applicant, aid, accounting and security evidence
The July 2026 WARR application checklist marks the application, ex-ante energy audit or feasibility analysis, the accounting-form financial table, SME-status declaration, schedule, AML, exclusion and conflict declarations, and investment/title/location evidence as always required. Asset, de-minimis/regional-aid, guarantor, business-plan, employment and other documents are conditional on applicant, aid route, accounting form, financing and security. The final security package requires WARR acceptance.

The form lists alternative accounting tables and aid/security cases; do not treat every annex as universally required. Before contract, tax and social-security no-arrears certificates are required after a positive decision, except where the applicant has operated for less than 90 days as stated in the application. This packet binds a stage-specific conflict: regulation §6(4) says business operated under 90 days at application; application body likewise says at application date, but the checklist says under 90 days at loan-agreement signature. Preserve both wordings pending clarification.

Application restrictionWARR Ekopożyczka pre-contract certificate requirement and applicant-age exception
Following a positive decision and within 7 days after the notice, original tax-office and social-insurance no-arrears certificates must be delivered before loan-agreement signature; each certificate must be no older than 90 days when submitted. The regulation and body text of the application exempt applicants that have operated for under 90 days on the loan-application date, while the application checklist states under 90 days on the agreement-signature date.

This is a documented wording conflict over the date used to measure <90 days of business activity; do not resolve by assuming either date. The certificate duty, freshness window and submission stage remain explicit.

Application restrictionPost-disbursement eligible-cost evidence and double-financing prevention
The WARR settlement workbook records the loan agreement, recipient, investment location, document type/issuer/number/date, payment date/method, gross amount and eligible expenditure amount; the recipient declares that an expenditure will not be financed more than once from EU funds or instruments.

This workbook is the WARR settlement record and does not expand the regulation’s eligible-cost list. Cash/payment evidence and item eligibility remain governed by the current rules and agreement.

Eligible geographyFinal investment location
The financed final investment must be implemented in Dolnośląskie Voivodeship.

This is the project-location test for the WARR Ekopożyczka route.

Eligible project scopeEligible final investment and cost classes
Enterprise energy-efficiency investments: energy modernization of buildings; heating/cooling installations; replacement or modernization of inefficient heat sources; energy-efficient production technologies and production lines; process energy recovery including waste heat; efficient lighting; qualifying renewable installations with storage; and other audited energy-efficiency expenditures. Additional eligible elements include energy audits, renovation-wave/green-space measures, circular economy, accessibility, e-mobility/adaptation and water efficiency.

Investment must concern an enterprise and be located in Dolnośląskie; planned activities (except audit preparation) must arise from the submitted audit. Renewable generation must serve covered buildings, equipment, installations or processes and electricity production cannot be the enterprise’s primary activity. Additional elements are subject to separate caps.

Other conditionExpenditure and VAT treatment
Eligible expenditure is financed at gross amounts including VAT, subject to additional restrictions under public-aid rules; combined financing must follow applicable eligibility and aid rules.

Do not assume VAT is eligible where public-aid rules restrict it.

Other conditionAlternative interest route
WARR may grant the unit loan on market terms instead of preferential terms; market interest is calculated from the applicable base reference rate plus a margin.

Actual rate/margin depends on rules applicable to the borrower and transaction.

Other conditionFees
No fee or commission is charged for granting the loan or standard servicing; additional costs can arise for extra servicing, noncompliance, unsettled costs, arrears or collection.

Additional fees/costs follow the WARR fee table and investment agreement.

Other conditionWARR collection, inspection and additional servicing costs under the adopted programme tariff
No standard origination or servicing fee; adopted tariff separately lists electronic reminder PLN 0; registered and final payment demands PLN 50 each; field collection inspection PLN 200 per location; termination, arrears arrangement, bill-of-exchange demand and other collection action PLN 200 each; qualifying second/later failed-site-control visit PLN 100 each; and second/later written request for the paid insurance policy assigned to WARR PLN 50 each. Borrower (and guarantors where applicable) also bears actual judicial, representation, enforcement, out-of-court collection and related charges.

Tariff applies to the listed nonstandard collection/inspection actions. Second/later control charge applies only where the prior visit did not occur on time due to borrower action/inaction and does not waive inspection duty. Second/later policy request charge applies when the paid policy with assignment to WARR was not delivered on time and does not waive delivery. The 2025-08-01 tariff is incorporated by 2026 regulation §6(4); check for replacement before transaction-specific pricing.

Other conditionImplementation timing condition
The loan finances only investment elements that are not physically complete or fully implemented when the financing partner makes its investment decision.

Apply at the financing partner investment decision, as defined in the cited eligibility guidelines.

Technical requirement, minimumMinimum primary-energy savings between pre- and post-investment conditions for each final investment; for multi-building projects, applies to each building, except heritage buildings.
30 percent reduction in primary-energy demand

An energy audit must confirm the difference between post- and pre-investment primary-energy demand is at least 30%; heritage buildings are excepted. If achieved savings are below 30%, expenses may be treated as ineligible and a corresponding part or all of the unit loan may have to be repaid. For multi-building investments, the 30% minimum applies to each building, except heritage buildings.

15 %

The listed additional elements under §4(2) are only supplementary and may not exceed this share of the unit loan amount.

Eligible cost limitEnergy-audit preparation cost, share of loan amount
3 %

Audit preparation expenditure, as a subsection of additional elements, may not exceed this share of the unit loan amount.

Eligible cost limitMaximum share of final investment expenditures that the unit loan may finance
100 %

This is loan financing of project outlays, not grant intensity. Final recipient must cover all ineligible expenditure.

Eligible cost limitRenewables subcomponent / eligible expenditures
49 %

OZE installations with storage are only an additional element, and generated electricity/heat must serve the covered project. This cap is a share of eligible expenditures.

Grace period, maximumRepayment schedule
12 month

Grace applies to principal, generally during implementation; it begins at disbursement and does not extend the repayment period. Interest accrues monthly during grace.

Loan interest, fixed rateMedium enterprise borrowers; preferential terms
2 percent per year

The ordinary preferential fixed rate for medium enterprises is 2% for the term. Under §7(3)(b), if the Commission reference base rate on the date the unit loan is granted is below 1%, the rate is instead the base rate plus 100 basis points. A separate market-rate option exists; borrower-specific route and rate are determined by applicable aid eligibility and partner decision.

Loan interest, fixed rateMicro and small enterprise borrowers; preferential terms
1 percent per year

Fixed for the full loan term on preferential/non-market terms. If the European Commission base rate on the loan date is below 1%, the fixed rate is instead that base rate. A separate market-rate route also exists.

Interest margin over the reference rate, fixed (basis points)Conditional preferential-rate branch for medium-sized enterprises when the Commission base rate on unit-loan origination is below 1%
100 basis points above the European Commission base rate applicable on the loan date

Only for the conditional medium-enterprise branch in §7(3)(b): when the Commission base rate at grant date is below 1%, the loan rate is that base rate plus 100 basis points. This is a spread above the named reference rate, not a universal rate or the ordinary 2% fixed preferential rate. The application/aid route and eligibility must be determined by WARR for the borrower.

Loan partial remission, maximum shareMedium enterprise in a designated strategic intervention area (OSI)
3 percent of unit-loan principal value
