Conditions16

Typed facts extracted from the source documents by Scindu's grant-data review. Each value keeps its own conditions. Unknown means unstated, not zero or unlimited.

Applicant restriction
The “transfer of funds” instrument is restricted to state budgetary units and may cover up to 100% of eligible costs. The grant instrument has a separate maximum of 99%.
Applicant type
Only public entities carrying out Article 26a waste-removal obligations for a minister-designated location are beneficiaries: the regional environmental protection director for closed areas and properties controlled by a municipality as land manager; the authority competent to issue the waste-management decision where the duty followed its withdrawal, invalidation, revocation or expiry; and in other cases the mayor, town mayor, or city president. Private cleanup contractors are not listed as beneficiaries.
Application restriction
Access criteria include complete and properly signed application; eligible public beneficiary; no NFOŚiGW termination/cancellation for applicant-side causes in prior three years except mutual termination; timely fulfilment of public and civil obligations; and a project not already completed before filing. Failure to meet any access criterion results in rejection.
Application restriction
The project may not be completed before application filing. For this programme, completion is expressly defined as submitting the WIOŚ opinion referred to in §9(5); this does not state that no earlier project costs can ever qualify, as the programme separately allows qualifying pre-application costs within intensity.
Application restriction
Applicants must propose removal of all waste at the location, transport and recovery/disposal, justify the chosen waste-management method, demonstrate complete financing and effectiveness, and document each stage through final recovery/disposal. The beneficiary must obtain and submit the WIOŚ written opinion confirming waste removal from the listed location and final management in accordance with the waste hierarchy.
Application restriction
The programme cost period runs from 2 January 2025 through 30 November 2035. Costs incurred before filing may qualify, but only up to the applicable funding intensity. This is subject to programme-specific exclusions and the cost-guideline version applicable on the date an application is filed.
Application restriction
The exact record identifies the 3.3 current 2026 call. The official call page, notice, and regulations set the intake from 12 October through 6 November 2026. The 23 October local source snapshot marks the route open; live GWD acceptance was not separately tested.
Application restriction
Grant instalments are paid only by reimbursement; the call notice does not describe an advance option for the grant route.
Application restriction
The admissibility-quality criterion requires the competent climate minister’s confirmation that both the project and requested funding amount correspond to the project selected for the minister’s list of locations appended to the programme. Being within a listed municipality alone does not establish project selection or amount approval.
Application restriction
The current attachment list requires a site plan with cadastral plot numbers; evidence that the legally responsible waste holder cannot be identified or enforced against (or an applicant declaration where documents do not exist); investor cost estimate or cost-calculation statement; estimated waste quantities; Article 26a decision and threat opinions; technical/project documentation where required (or a declaration if unavailable); evidence of other financing sources when used; and other issued decisions/documents.
Application restriction
The applicant must document implementation under Article 26a, provide the opinions under Article 26a(5) confirming threat to human life/health or the environment, and include the Article 26a decision. The programme criterion requires both opinions and decision; the attachment list identifies them as required documents.
Eligible geography
The programme restricts financed locations to the Minister’s attached 2026 list: gmina Sławków (śląskie), gmina Zgierz (łódzkie), gmina Czempiń (wielkopolskie), gmina Pierzchnica (świętokrzyskie), gmina Janowiec Wielkopolski (kujawsko-pomorskie), gmina Stargard (zachodniopomorskie), gmina Sieradz (łódzkie), gmina Nowiny (świętokrzyskie), gmina Koronowo (kujawsko-pomorskie), gmina Wąchock (świętokrzyskie), and gmina Żywiec (śląskie). A project outside this list is not supported by the reviewed 2026 annex.
Eligible project scope
The route finances removal and management of improperly landfilled or stored hazardous waste and co-occurring non-hazardous waste at a minister-designated site. Listed project types include waste that resulted from a fire involving improperly stored waste. Cost eligibility expressly includes removal, transport, recovery and/or disposal; the project must address all waste at that location and its final management.
Other condition
If the NFOŚiGW annual financial-plan limit is exhausted, planned payments may be moved to the next year, but no more than 50% of the amount planned for payment in a given year may be shifted.
Other condition
The beneficiary must pursue cost recovery from the legally responsible waste holder. Recovered amounts must be remitted to NFOŚiGW up to the beneficiary’s obligations under the funding contract within 14 days after receipt. If the cleared land is disposed of for consideration within 10 years after physical project completion, the beneficiary must repay all or up to the financial benefit, as applicable.
Other condition
The source documents are internally inconsistent on the year of the Waste Act: the programme §7.4 and call notice beneficiary paragraph say 14 December 2022, while programme §7.3 and the regulations’ legal-basis section say 14 December 2012. The review preserves this discrepancy without deciding which citation the operator intended; the common operative element stated is Article 26a.
Amounts and costs6
Call allocation
PLN 300,000,000

Call-wide allocation, not an individual project cap. The programme-wide envelope is separately up to PLN 500m.

Call allocation
PLN 500,000,000

Programme-wide envelope through implementation period, distinct from the PLN 300m allocation for the current 2026 call.

Eligible cost
Eligible costs are only costs of waste removal, including transport, recovery or disposal. Costs of remediation are excluded. This is narrower than general clean-up or site-rehabilitation costs.
Eligible cost limit
5 percent of total eligible project costs

A cap on eligible preparation costs, not a funding intensity or project award amount.

Funding intensity, maximum
99 percent of eligible project costs

Grant up to 99% for eligible beneficiaries; transfer up to 100% applies only to state budgetary units. The maximum differs by funding form and applicant type.

Ineligible cost
Programme-specific exclusions include beneficiary-employee project-management costs; land/property acquisition; acquisition of fixed assets, equipment, furnishings or intangible assets; and environmental authority compensation owed to the land manager. The employee exclusion is explicitly limited to project management, and should not be generalized to all direct cleanup labour without reviewing the applicable guideline.
Personnel and services1
  • Other role

Staff cost the grant can fund

Conditional generic personnel-cost category only for employees performing directly eligible project operations (removal, transport, recovery or disposal), not beneficiary-employee project management, which the programme expressly excludes. Under the current P.1.1-13 general cost-guideline text captured 23 October 2026, the job description/duties must identify specific project tasks, only the proportional project-work share is eligible, and potentially eligible components are gross pay and employer statutory costs. Because this is a continuous call, the version in force on the individual application filing date governs; this row is conditional on that version remaining applicable and the direct operating duties meeting the programme-only eligible-cost scope. No particular hire, salary, headcount or pay level is asserted.
